Fred the Oyster uploaded the current version on 1 April 2010, and states that it was "traced from a [http://books.google.com/books?id=TdTMkYgOkLYC&pg=P177 scanned image of Konstam's book]", which was published in 2007. It is undoutable that the new version is of better aesthetic quality than the original; however, there seems to be two issues... # the license, attributing the image to Open Clip Art Library, is wrong for this current version; the image is now a derivative of Konstam's version, which leads us to... # I believe Konstam's imagination of the flag is copyrighted per Commons:Coats of Arms; i.e. the definition (a horned skeleton holding a chalice and piercing a heart with a harpoon) is in public domain by age, but representations of this definition can be copyrighted. Thus, I believe the image should be restored to the [http://upload.wikimedia.org/wikipedia/commons/archive/0/04/20100401123939%21Pirate_Flag_of_Blackbeard_%28Edward_Teach%29.svg first version] (whose author has placed it in public domain), and the [http://upload.wikimedia.org/wikipedia/commons/0/04/Pirate_Flag_of_Blackbeard_%28Edward_Teach%29.svg second version] (uploaded on 1 April 2010) deleted.
